    <\/strong><\/li>\n\n\n\n
  • Detainment at jails or detention centers<\/strong>
    <\/strong><\/li>\n\n\n\n
  • Checkpoints or traffic stops<\/strong>
    <\/strong><\/li>\n<\/ul>\n\n\n\n

    Each situation requires a calm, informed response. But regardless of where or how you encounter ICE, the law protects certain basic rights.<\/p>\n\n\n\n

    2. Your Legal Rights During an ICE Encounter<\/strong><\/h2>\n\n\n\n

    It\u2019s vital to understand that you have rights regardless of your immigration status<\/strong>. These are protected under the U.S. Constitution and must be respected by ICE agents. Here are your core rights:<\/p>\n\n\n\n

    Right to Remain Silent<\/strong><\/h3>\n\n\n\n

    You are not obligated to answer any questions about:<\/p>\n\n\n\n

    • Your immigration status
      <\/li>\n\n\n\n
    • Where you were born
      <\/li>\n\n\n\n
    • How you entered the country
      <\/li>\n<\/ul>\n\n\n\n

      You can say:
      “I am exercising my right to remain silent.”<\/strong><\/p>\n\n\n\n

      Right to Refuse a Search Without a Warrant<\/strong><\/h3>\n\n\n\n

      ICE must have a valid judicial warrant signed by a judge<\/strong> to legally enter your home. Administrative warrants (ICE Form I-200 or I-205) are not sufficient<\/strong> to authorize entry.<\/p>\n\n\n\n

      You are not legally required to open the door unless ICE presents a valid judicial warrant.<\/p>\n\n\n\n

      1. Ask them to slide the warrant under the door or hold it up to a window.
        <\/li>\n\n\n\n
      2. Look for a judge’s signature<\/strong>, your correct name<\/strong>, and address<\/strong>.

      3. If the warrant is invalid, do not<\/strong> open the door. Tell them, politely but firmly, that you do not consent to a search.

        Do Not Sign Anything Without a Lawyer<\/strong><\/h3>\n\n\n\n

        ICE may pressure you to sign forms or “voluntary departure” orders. Do not sign anything without legal advice<\/strong>, as this could result in immediate deportation or forfeiture of your rights.<\/p>\n\n\n\n

          “I wish to remain silent and speak with a lawyer.”<\/strong>

        • Do not<\/strong> lie or present false documents, as this can worsen your legal situation.
          <\/li>\n<\/ul>\n\n\n\n

          Ask If You\u2019re Free to Leave<\/strong><\/h3>\n\n\n\n

          You can ask:
          “Am I free to go?”<\/strong>
          <\/strong> If the officer says yes, walk away calmly. If they say no, you are being detained and should request legal counsel immediately.<\/p>\n\n\n\n
